Workers’ Compensation Attorney Fees
A lot of attorneys charge by the hour, but workers’ compensation attorneys do not. These attorneys must comply with specific rules outlined in 85A OK Stat § 82. Instead of charging an hourly rate, workers’ compensation attorneys take a small percentage of the benefits awarded to their clients.
For example, attorneys are permitted to take up to 10% of temporary total or temporary partial disability benefits. They are also allowed to take up to 20% of permanent total or permanent partial disability benefits. But, they cannot take a percentage of compensation awarded to injured workers for medical benefits or treatments. A lawyer can also not collect attorney fees if the client’s claim is not controverted. This means attorneys cannot be compensated unless your employer contested some aspect of your claim and your case went before the Workers’ Compensation Commission.
In addition, an attorney cannot be compensated unless the fees for his legal services have been reviewed and approved by the Commission.
